Pursuant to Section 21 paragraph 1 of the German Securities Trading Act (Wertpapierhandelsgesetz - WpHG), on 26 October 2009 we received notification from the AVI Germany Fund I, George Town, Grand Cayman, Cayman Islands, that on 8 October 2009 its share of the voting rights in TOMORROW FOCUS AG, Munich, Germany (ISIN: DE0005495329, German securities code (WKN): 549532) exceeded the threshold of 3 percent of voting rights to stand on that day at 1,816,250 (equivalent to 3.43 percent of total voting rights).

On 26 October 2009, pursuant to Section 21, paragraph 1 of the German Securities Trading Act, we were notified by Active Value Investors Fund Advisor N.V., Curacao, Dutch Antilles, that on 8 October 2009 its share of the voting rights in TOMORROW FOCUS AG, Munich, Germany (ISIN: DE0005495329, German securities code (WKN): 549532) exceeded the threshold of 3 percent of voting rights to stand on that day at 1,816,250 (equivalent to 3.43 percent of total voting rights). In accordance with Section 22, paragraph 1, sentence 1, point 1 and Section 22, paragraph 1, sentence 1, point 6 of the German Securities Trading Act, all these voting rights are allocated to Active Value Investors Fund Advisor N.V. Curacao, Dutch Antilles.

Active Value Investors Fund Advisor N.V. Curacao, Dutch Antilles holds allocated voting rights through the following companies, all of which it controls and whose share of the voting rights in TOMORROW FOCUS AG is equal to or greater than 3 percent: - AVI Germany Fund I It is also allocated voting rights from the following shareholders, whose share of voting rights in TOMORROW FOCUS AG is equal to or greater than 3 percent: - AVI Germany Fund I

On 26 October 2009, pursuant to Section 21, paragraph 1 of the German Securities Trading Act, we were notified by Dr Hubertus Hoffmann, UK, that on 8 October 2009 his share of the voting rights in TOMORROW FOCUS AG, Munich, Germany (ISIN: DE0005495329, German securities code (WKN): 549532) exceeded the threshold of 3 percent of voting rights to stand on that day at 1,816,250 (equivalent to 3.43 percent of total voting rights). In accordance with Section 22, paragraph 1, sentence 1, point 1 and Section 22, paragraph 1, sentence 1, point 6 in conjunction with sentence 2 of the German Securities Trading Act, all these voting rights are allocated to Dr Hubertus Hoffmann. Dr Hubertus Hoffmann holds allocated voting rights through the following companies, all of which he controls and whose share of the voting rights in TOMORROW FOCUS AG is equal to or greater than 3 percent: - Active Value Investors Fund Advisor N.V. - AVI Germany Fund I He is also allocated voting rights from the following shareholders, whose share of voting rights in TOMORROW FOCUS AG is equal to or greater than 3 percent: - AVI Germany Fund I
